Regulations for the Rental of 16mm Film, VHS, DVD & Licensing
We recommend that you read this entire page to be sure on all of our rental regulations.
All movies are rented for non-theatrical showings only and are only to be shown within the continental United States. They may not be used for theatrical showings nor in competition with established movie theatres. Any form of television use, (open or closed circuit) is strictly forbidden.
Films cannot be duplicated, taped or copied. Films rented are to be shown only at the time and place under the conditions specified on rental order request. Any form of public advertising is prohibited. Orders from movie theatres are not acceptable.
Signed affidavits setting forth the details will also be required for producer records.
Rental Rates
All rentals are based on one day, one showing, at one location. Add 50% for each additional time the film is shown in a 24 hour period.
Movie Use and Late Returns
You are billed only for the actual day or number of times the film is shown. You are not charged for time the film is in transit.
Film must be mailed back on the first working day after your scheduled showing is completed.
Please return rented formats immediately following your use. Don't disappoint the next user.
Unauthorized hold-overs and late returns are chargeable at two and a half times the full catalog rate per week the film is late.
Features on a Serialized Basis
We realize that class periods usually do not permit the showing of an entire feature film in one day. You may order feature films and run them over a period of two to four days at the one day rate. Serialized means to show a portion each day to fit your class period and allows one run through the projector.
Add 50% to the rental for each additional showing to accommodate additional classes.
In ordering, please mention Serialized and indicate the number of showings per day and number of days required.
This special plan does not apply to short subjects or short subject packages.
Billing Information
If your organization requires a purchase order number, please indicate number on your request or on our order blanks. An authorized signature is also required. We will also complete and return any vouchers or claim forms for your records.
When your order is placed you will receive a Confirmation either by fax or US Mail. Please do not remit from this copy. At the time the film is shipped you will receive the Invoice and Remittance copy which will include the total amount of the rental.

Method of Payment
Schools, institutions, churches and civic organizations will be served open account.
All invoices are net and payable when invoice is received.
All other renters must pay in advance to the showing unless otherwise agreed upon.
Checks returned marked insufficient funds are subject to a $30.00 handling fee.
Individuals are supplied on a C.O.D. basis and three business references are also required.
Advance Bookings
It is always advisable to order as far in advance as possible.
Quite frequently we receive orders for films which are already booked.
In ordering please list alternate titles or advise if we may substitute a similar title.
Cancellations
Written cancellations can be made if this information is received in our office twenty-one days prior to show date. Once shipment has been made, a cancellation cannot be made and the rental is due.
Weather Related Show Date Changes
Bad weather may cause early school dismissal. The rental on the film will be due. Call us immediately to let us know of cancellation. A new date must be chosen within 30 days. The new date can be no later than 6 months after previously reserved show date. If a new date cannot be chosen within these terms of cancellation, the rental will have to be billed for the original date.
16mm Projector Operation
Only a person thoroughly qualified to use a 16mm sound projector should be allowed to use such equipment. Irreparable damage can be done to the 16mm films and projector from inexperienced operators.
Do not attempt to run sound films on a silent projector-to do so will destroy the film.
Keep your sound projector clean, especially those parts which contact the film. Numerous scratches are caused on the picture surface by collection of dirt particles on aperture gates and tension shoes.
Sound Reproduction
The sound quality on all films is checked and found to be perfect.
Claims of poor sound reproduction will not be honored.
In threading, it is most important that you form the proper loop around the sound drum. Improper loops will cause indistinct, garbled, low sound or a motor-boating effect.
Reel Bands for16mm Film
Like the cover on a book, our reel bands are used for identification and the protection of film ends. Please replace them when returning the film so that the film will not come loose on the reel and be partially damaged upon return.
Movie Damage or Loss
All rented formats are inspected upon return. If format is found to be damaged Modern Sound Pictures, Inc. reserves the right to bill user for cost of replacement footage. 16mm film is expensive, when not in use it should be stored in a locked room to avoid theft. You are responsible for film while in your possession and shall pay Modern Sound Pictures, Inc. the replacement cost, and supply Producer affidavits for any film which is lost, stolen, destroyed or not returned. Police and F.B.I. reports may also be required.
No-Loan Rule
Do not loan or permit anyone to use the movie while in your possession. Call us first as we must authorize the showing and bill second user. It is the user’s responsibility to store the any rented format provided by Modern Sound Pictures, Inc. in a safe place while in their possession. If a film is lost or stolen while in the user’s possession, or if the film is not insured and is lost in transit, Modern Sound Pictures, Inc. will bill the user for replacement cost.
Transportation Charges
User pays transportation both ways.
There is a $35.00 charge for round trip UPS Ground transportation, shipping and handling for each 16mm Feature Film.
There is an $18.00 charge for round trip UPS Ground transportation, shipping and handling for each DVD, VHS Video and 16mm Short Subject Program.
However, if next day or second day delivery is requested, it will be billed at current rates.
When returning films by mail or UPS, make certain you insure for a minimum of $500.00 and keep a traceable receipt.
Films which are uninsured and subsequently lost in transit will be billed to the user at full replacement cost.
Withdrawals
From time to time producers request that their films be withdrawn from rental service. In other instances, we are unable to secure lease extensions on certain titles. Under the above circumstances we reserve the right to offer a substitute title to be selected by the user if a movie title must be withdrawn immediately.
Film Ratings
The rating given the film by the
Code and Rating Administration of the Motion Picture Association of America.
G General Audience-all admitted.
PG or M Parental guidance suggested-all ages admitted.
PG-13 Parents are strongly cautioned to give special guidance for children under 13.
R Restricted under 17 requires accompanying parent or adult guardian.
Caution
To fraudulently obtain a movie, using the name of a non-existent organization or assumed name, is a violation of the U.S. Postal laws and regulations.
The subsequent use of the film, obtained under these circumstances, is in violation of Copyright Law and both may subject person, or persons, to prosecution.
Additional Information
We reserve the right to cancel or refuse service depending upon the intended use of the pictures.

Rights
16mm and VHS movies are sold for private, non-theatrical use and only within the United States.
16mm Non-Theatrical, Television, Video, Theatrical, Internet – All Rights – Including advertising materials, without exception, are reserved by the film’s copyright owner.
Conditions of Sale
All 16mm films and VHS tapes are carefully inspected before shipping and is sold on as “as is” basis. Modern Sound Pictures, Inc. discloses all conditions to the best of our knowledge and we strive to provide the closets condition information possible. Again, films are sold on an “as is” basis. Therefore, Modern Sound Pictures, Inc. is not responsible for any discrepancy therein. There are absolutely no refunds, exchanges or warranties provided on film, VHS or Beta.
Transportation
We only ship our movies by UPS and only within the United States. We will figure specific costs for you to match your order size. We can only accept physical addresses to ship packages to.
Payment Methods
We can accept Money Orders, Casher’s Checks and credit cards – Visa, Master Card or American Express. If paying with credit card, please call or fax in your information.
Holds
We suggest putting films on hold while waiting for payment to arrive to ensure you receive all of the films you are interested in. We can hold films for customers up to 10 days after confirming order. If you do not confirm, we will not place the film on hold. If you need a brief extension period (10 additional days max) please call and let us know. Not a problem. |
